By accessing or using the Wikkel platform (the "Platform"), creating an account, or engaging any services offered through the Platform, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Wikkel ("we", "us", "our") in accordance with Section 22 of the Electronic Communications and Transactions Act 25 of 2002 ("ECT Act"). Electronic acceptance of these Terms (including by ticking the acceptance checkbox at registration) is deemed a valid signature for the purposes of South African law.
Wikkel reserves the right to update these Terms at any time. Continued use of the Platform following notification of changes constitutes acceptance of the revised Terms.
In these Terms, unless the context indicates otherwise:
Wikkel operates solely as a technology marketplace and intermediary platform. Wikkel does not itself provide any construction, plumbing, electrical, roofing, painting, landscaping, or any other trade or property services.
The relationship for the actual performance of Services is directly between the Customer and the Contractor. Wikkel is not a party to any service agreement formed between a Customer and a Contractor. Accordingly, Wikkel makes no representations, warranties, or guarantees regarding the quality, safety, lawfulness, or suitability of any Services performed by Contractors.
Wikkel's role is limited to: (a) providing the Platform to facilitate introductions between Customers and Contractors; (b) processing payments as a payment intermediary; (c) displaying profiles, ratings, and reviews to assist Customers in making informed decisions; and (d) providing dispute facilitation support as described in these Terms.
Nothing in these Terms creates an employment relationship, partnership, joint venture, agency, or franchise between Wikkel and any User.
You must be at least 18 years of age and legally capable of entering into binding contracts under South African law to register on the Platform. By registering, you represent and warrant that you meet these requirements.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Wikkel reserves the right to suspend or terminate any account, at its sole discretion, for breach of these Terms, fraudulent conduct, conduct harmful to other Users, or any other reason Wikkel deems appropriate. Where required by the CPA, Wikkel will provide reasonable notice before termination except in cases of serious misconduct or fraud.
Contractors registered on the Platform are independent contractors and not employees, agents, representatives, or partners of Wikkel. Wikkel exercises no control over the manner or method by which Contractors provide their Services, nor over the quality or outcome of such Services.
Contractors are solely responsible for:
Wikkel does not verify the qualifications, licences, insurance, or fitness of Contractors beyond the information submitted during registration. Customers should make their own enquiries before engaging a Contractor.
As a Customer, you agree to:
As a Contractor, you agree to:
A Booking is formed when a Customer and Contractor reach agreement on the scope, timing, and cost of Services through the Platform. Wikkel acts as a payment intermediary only and is not responsible for the performance of Services under any Booking.
Wikkel charges a platform service fee on Bookings, which will be clearly disclosed to both parties prior to confirmation. Wikkel reserves the right to adjust its fee structure with reasonable advance notice to registered Users.
Payments processed through the Platform are facilitated by third-party payment service providers. Wikkel does not store card details. By transacting on the Platform, you agree to the applicable third-party payment terms and conditions.
Cancellation and refund policies for individual Bookings are set at the time of Booking or as stated in the Platform's cancellation policy in effect at the time. Where a Contractor cancels a confirmed Booking, Wikkel will use reasonable efforts to facilitate a remedy, which may include a refund of any amounts paid.
Refunds and cancellation outcomes are determined on a case-by-case basis. Nothing in this clause limits the rights of Customers under the CPA where applicable.
Users must not, through the Platform or in connection with any Booking:
Violation of this clause may result in immediate account suspension or termination without refund, and may result in civil or criminal referral to the relevant South African authorities.
To the maximum extent permitted by applicable South African law, Wikkel, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
Where Wikkel's liability cannot be entirely excluded under applicable law (including the CPA), Wikkel's aggregate liability to any User shall not exceed the total platform fees paid by that User in the 12 months immediately preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Wikkel and its affiliates, directors, officers, and employees from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or the rights of any third party.
Nothing in this clause is intended to limit or exclude any rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other applicable mandatory South African legislation.
All intellectual property rights in the Platform, including its design, software, trademarks, logos, and content created by Wikkel, are owned by or licensed to Wikkel. You may not reproduce, distribute, modify, or create derivative works of any Platform content without Wikkel's prior written consent.
By submitting Content to the Platform (including reviews, photographs, and profile information), you grant Wikkel a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that Content in connection with the operation of the Platform.
Disputes arising from a Booking are primarily the responsibility of the Customer and Contractor to resolve directly. Wikkel may, at its sole discretion, offer dispute facilitation assistance, but is under no obligation to adjudicate or resolve any such dispute.
Any dispute between a User and Wikkel shall first be referred to good-faith negotiation for a period of 21 (twenty-one) business days. If unresolved, the parties shall attempt mediation through a mutually agreed mediator.
If mediation is unsuccessful, the dispute shall be finally resolved by arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa ("AFSA"), which rules are deemed incorporated by reference. The seat of arbitration shall be Cape Town, South Africa, and the language of arbitration shall be English.
Notwithstanding the above, either party may approach a competent court for urgent or interim relief. Nothing in this clause prevents a Consumer from exercising rights under the CPA, including lodging a complaint with the National Consumer Commission.
Wikkel reserves the right to amend these Terms at any time. Material changes will be communicated to registered Users via email or an in-platform notification at least 20 (twenty) business days before taking effect, in accordance with the ECT Act. Continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-law principles.
Subject to the dispute resolution provisions above, the parties consent to the non-exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town, for the resolution of any disputes arising under these Terms.
